Michael Sharkey, Partner, Pekins Coie

Michael Sharkey is a partner in the Insurance Recovery group at Perkins Coie. He concentrates his practice on representing policyholders in insurance coverage disputes nationwide. He has represented clients in a wide variety of insurance matters and policies, obtaining numerous significant and precedent-setting rulings on key insurance coverage issues. He has assisted Kentucky-based policyholders obtaining insurance recoveries for such losses as claims for chemical exposure, recalled peanuts, and carpal tunnel syndrome.
Michael also regularly advises clients on the insurance issues that arise in connection with corporate transactions, as well as on the drafting and interplay of insurance and indemnification provisions in contracts, with the goal of aligning the provisions with the parties’ intent during the drafting process – before a dispute arises.
Potential Pitfalls in Excess Coverage (and how to avoid them)
Excess policies are expected to align seamlessly with underlying coverage, but hidden pitfalls often surface after a loss. Questions can arise about which policy is followed, what language is excluded, or whether notice and cooperation failures apply. Inconsistencies across the coverage tower—such as choice-of-law provisions—can also create disputes. This session explores common challenges in excess programs and steps to avoid surprises when placing coverage.
